Terms of Service

1. General Terms

These terms govern the use of the Alakonnu Ralli website and participation in the event.

By using the website and/or purchasing a ticket, you confirm that you have read and agree to these terms.

2. Rally Participation

To participate in the rally, you must meet the following requirements:

  • Hold a valid A or A2 category motorcycle license
  • Have a technically sound motorcycle with valid insurance
  • Wear an ECE-certified helmet and appropriate protective gear
  • Be at least 18 years old
  • Be sober (no alcohol or drugs)
  • Follow instructions from the event crew throughout the rally
  • Respect traffic rules when riding on public roads

The organizer reserves the right to refuse participation or remove any participant who does not meet the requirements or violates rules, without refunding the ticket price.

3. Tickets and Right of Withdrawal

Tickets are non-refundable in accordance with the Estonian Law of Obligations Act § 53(4)(3), as this is a leisure event taking place on a specific date.

Exceptions:

  • If the event is completely cancelled due to organizer fault, 100% refund will be provided
  • If the event is significantly modified (date, location), buyers have the right to a refund within 14 days of being notified

Ticket transfer: Tickets can be transferred to another person by notifying the organizer via email ([email protected]) at least 7 days before the event. Transfer is free of charge.

Invoice payments: The standard invoice payment deadline is 7 days from invoice issue date. If there are less than 60 days left until the event, the invoice payment deadline is 3 days. One reminder email is sent for unpaid invoices (on day 5 or day 2 respectively), and the order may be automatically cancelled after the payment deadline passes.

4. Online Shop Terms

Right of withdrawal: Under the Estonian Law of Obligations Act § 56, consumers have the right to withdraw from distance contracts within 14 days of receiving the goods, without giving a reason.

Return conditions:

  • Product must be unused and in original packaging
  • Return shipping costs are covered by the buyer
  • Refund will be issued within 14 days of receiving the returned goods

Prices: MTÜ Särevärin is not a VAT-registered entity, therefore prices do not include VAT. Shipping costs are added during checkout.

Delivery methods: Shop products may support delivery to a street address and/or a parcel locker or pickup point. Available delivery methods are shown during checkout based on the product.

Parcel locker / pickup point selection: When selecting a parcel locker or pickup point, the buyer is responsible for choosing a suitable location (including location, access and opening hours). We pass the selected carrier and pickup-point details to the fulfillment flow. Carrier networks and availability may change in third-party systems.

Delivery partners: We may use Omniva, SmartPosti (Itella SmartPOST), DPD, and other carriers shown during checkout.

5. Limitation of Liability

Rally participation is at your own risk and responsibility.

To the maximum extent permitted by law, the organizer is not liable for:

  • Participant injuries, health damage, or death
  • Vehicle damage, theft, or destruction
  • Loss, damage, or theft of personal belongings
  • Damage caused by third parties
  • Indirect damages, lost profits, or non-pecuniary damages

⚠️ Insurance: We strongly recommend obtaining travel, accident, and liability insurance. Ensure your insurance covers motorcycle sport activities.

6. Force Majeure

The organizer is not liable for failure to perform obligations due to force majeure, including:

  • Extreme weather conditions (storm, flood, earthquake)
  • Epidemics, pandemics, or quarantine restrictions
  • War, terrorism, civil unrest, or state of emergency
  • Government decisions preventing the event
  • Power, communication, or infrastructure failures

In case of force majeure, the organizer will notify participants as soon as possible and offer alternatives (e.g., new date) or partial refunds.

7. Event Modification and Cancellation

The organizer reserves the right to:

  • Modify the event schedule, route, or timetable for safety, weather, or other justified reasons
  • Cancel the event due to force majeure or other objective circumstances

Schedule modifications do not entitle refunds. In case of complete cancellation, ticket prices will be refunded or alternative solutions offered.

8. Photography and Filming

Photos and videos will be taken during the event, which the organizer may use for:

  • Social media and marketing channels
  • Website and printed materials
  • Media coverage

By participating, you grant the organizer a free, perpetual, and geographically unlimited right to use your image for the above purposes. If you do not wish to be photographed, please notify the organizer before the event.

9. Intellectual Property

All Alakonnu Ralli trademarks, logos, design elements, and website content are the intellectual property of the organizer or used under license. Without written permission, it is prohibited to:

  • Copy, distribute, or modify content
  • Use trademarks for commercial purposes
  • Automatically scan the website or collect data

10. Dispute Resolution

These terms and all disputes arising from them are governed by the laws of the Republic of Estonia.

Disputes will be attempted to be resolved through negotiations. If no agreement is reached, consumers may contact:

  • EU Online Dispute Resolution platformec.europa.eu/odr

For court disputes, jurisdiction lies with Tartu County Court.

11. Other Provisions

Severability: If any provision is found invalid, this does not affect the validity of the remaining provisions.

Entire agreement: These terms constitute the complete agreement between the parties and supersede all prior oral or written agreements.

Amendments: The organizer may amend these terms by providing at least 14 days' notice via the website. Changes do not apply retroactively to already purchased tickets.
